For what purposes do we process your personal data?
HOLIDAY GOLF S.L. processes the information provided by interested parties for the following purposes, depending on their interaction with the web:
A) Online Store Management (WooCommerce):
Order management: To process your purchase, manage the payment and ship the purchased products.
User account creation: Manage your registration on the platform to speed up future purchases and consult your order history.
Customer Service: Resolve queries, doubts or incidents related to your orders through our forms or email.
B) B2B Relationships (Companies and Professionals):
Management of the commercial relationship with professional customers, specific invoicing and management of special wholesale conditions.
C) Commercial Communications:
In case you have given us your express consent (e.g. by subscribing to the newsletter), we will send you information about Ofelia T.’s news, offers and promotions.
How long will we keep your data?

In order to provide our services to you, we share strictly necessary data with the following external service providers:
Transportation and logistics companies: In order to deliver your order to the address indicated.
Payment platforms: Banking institutions and secure payment gateways integrated into WooCommerce (e.g. Redsys, PayPal, Stripe) to process the payment. HOLIDAY GOLF S.L. does not store your full credit card details.
Hosting and web maintenance: Technology service providers that host our website and emails.
Management and Consulting: For the fulfillment of tax and accounting obligations.
No data will be transferred to third parties unless required by law.
International Data Transfers
Our main servers are located in the European Union. However, if we use service providers (such as email marketing or Google-type analytics tools) located outside the European Economic Area, we ensure that they provide adequate security safeguards (such as adherence to the Data Privacy Framework or use of EU Standard Contractual Clauses).

Any person has the right to obtain confirmation as to whether or not HOLIDAY GOLF S.L. is processing personal data concerning them.

Data Security
As our website is based on WordPress and WooCommerce, we implement technical and organizational security measures (use of SSL/HTTPS certificates, secure passwords and security plugins) to protect your data against loss, misuse, alteration or theft.
Accuracy and veracity of the data
The user (or the company in the case of B2B) guarantees that the personal data provided to HOLIDAY GOLF S.L. are truthful and is responsible for communicating any changes to them.
Obligations of the parties
Payment
The price of the products will be the one that is stipulated in every moment in the WEBSITE, except in case of manifest error. Although OfeliaT tries to ensure that all prices listed on the WEBSITE are correct, errors may occur. If OfeliaT discovered an error in the price of the products that the client has ordered, OfeliaT, after informing him as soon as possible, will proceed to cancel the order. If OfeliaT fails to contact the customer, the order will be considered canceled and will be fully refunded the amounts that had been paid.
OfeliaT is not obliged to supply products (even if the Shipping Confirmation has been sent) if the error in the price is obvious and unequivocal and could have been reasonably recognized by the customer as an incorrect price.
The prices of OfeliaT products may vary, but (except as stated above) any changes will not affect orders for which a Shipping Confirmation has already been sent.
Given the particularities of the online purchase, the price of the products indicated on the WEBSITE refers solely and exclusively to purchases made on the same, without having to coincide with the retail price of OfeliaT establishments. In accordance with the above, the price indicated on the WEBSITE is only considered binding for online purchases and in no way binds OfeliaT establishments.
The prices on the website include VAT, but exclude shipping costs, which will be added to the total amount due and will be indicated to the customer in an itemized form.
Once the customer has made his purchases, all the items he wishes to buy will have been added to his bag and the next step will be to process the order and make the payment. To do this the customer will follow 6 steps:
- You will click on “My Bag” at the top of the page to add the products you wish to purchase.
- Then click on “Buy”.
- You will fill in and check the contact information, the details of your order, the address to which you want the order to be sent or the store where you want it to be picked up.
- You will choose the payment method you wish to use to make the purchase.
- You agree to the “Terms and Conditions”.
- Confirm your purchase by clicking on “Checkout “.
By clicking on “Authorize Payment” the customer is confirming that the credit card is theirs.
OfeliaT uses Redsys to ensure that the payment has been made securely.
Credit cards will be subject to checks and authorizations by the credit card issuer; if the credit card issuer does not authorize payment, OfeliaT is not responsible for any delay or non-delivery and, ultimately, for not proceeding to formalize the sales contract with the customer.
Value added tax (VAT)
In accordance with the regulations in force, any purchase made through the Web site shall be subject to Value Added Tax (VAT), which shall be charged at the rate in force at the time of delivery.
For orders destined to Ceuta and Melilla, deliveries would be exempt from VAT without prejudice to the application of the corresponding taxes and tariffs in accordance with the regulations in force in each of them.
Delivery
The shipment will be made by a transport company outside OfeliaT, which is committed to deliver the product paid by the customer to the delivery address within a period of approximately:

These periods may be extended up to 90 days for any of the following reasons:
- Product customization.
- Specialty items.
- Unforeseen circumstances not attributable to OfeliaT.
- Product out of stock.
If for any reason the delivery of the order is delayed beyond the time period specified after the purchase, we will inform you of this circumstance and you will be given the option to go ahead with the purchase by setting a new delivery date or cancel the order with a full refund of the price paid. Please note that we do not deliver on Saturdays or Sundays.
For the purposes of these Conditions, delivery shall be deemed to have taken place or the product(s) to have been delivered at the time of signing for receipt thereof at the agreed delivery address.
The risks of the Products shall be borne by the customer from the time of delivery.
The customer shall acquire ownership of the products when full payment of all amounts due in connection therewith, including shipping costs, is received.
There will be no shipping costs for orders of 99€ or more.
Withdrawal
The customer has the right to withdraw from the contract within FOURTEEN (14) calendar days of receipt of the item.
To formalize the withdrawal, the customer must log into their personal area within the indicated period and fill out the returns form, along with the details of the items. A courier will pick up your order as soon as possible without any cost or you can leave the item in the selected store within 7 days.
Formalized the withdrawal and returned the item with its original packaging and brand seal in perfect condition, we will proceed to refund the amount in the shortest possible time, and in any case, within fourteen calendar days from the time OfelitaT has become aware of the withdrawal of the customer.
All payments received will be refunded, including delivery charges if any. The means used for the refund will be the same by which the payment was made. If the method of payment chosen was cash on delivery, the payment will be made by transfer to the customer’s bank account.
Cancellation form
The customer will receive the withdrawal form with his order, but in case he needs it, the information it should contain is as follows.

In cases where the return or exchange of the purchased product is accompanied by a promotional gift, the return of the product would entail the simultaneous return of the gift, all in the same condition in which it was delivered. In the event that the gift cannot be returned or is not in the condition in which it was delivered, the return of the product that gave right to the gift will not be accepted, unless the amount of the gift is paid.
Existence of warranty
OfelitaT offers its customers products and services of the highest quality.
The gold used for the manufacture of the pieces is of 750 thousandths (18 carats) or 375 thousandths (9 carats), the silver of 925 thousandths, the platinum of 950 thousandths.
OfelitaT buys diamonds directly at the place of origin. OfelitaT diamonds of 0.30 carats or more are accompanied by their GIA certificate and comply with the conditions of the “Kimberley Treaty” (certification scheme for the international trade of diamonds not originating from conflict countries).
Given the special characteristics of the products marketed by OfelitaT on its website, there are slight differences between each product or service purchased, mainly due to the uniqueness and exclusivity of each and every one of the materials and stones used in its manufacture, which is also largely handmade. Therefore, no two OfelitaT products or services are exactly alike and, in any case, it is inevitable that the product delivered to the customer differs slightly from the one shown in the photographs included in the purchase process of the website (even if it had been the same). In no case, these differences will imply the delivery of products or services with worse quality of materials than those expressly mentioned in the Portal. Likewise, the customer is informed and is aware that the size of the photographs contained in the Portal does not correspond to the actual size of the OfelitaT products offered.
Therefore, the customer is informed and expressly consents to these circumstances and differences, without them being a cause for termination of the Contract.
In any case, without prejudice to the provisions at the beginning of the section, OfelitaT products purchased by the customer through the purchase procedure established on the WEBSITE have the legal guarantee of consumer goods, that is, their conformity with their description on the WEBSITE and with these Special Conditions.
OfelitaT is liable for any lack of conformity that becomes apparent within two years of delivery. The consumer must inform the seller of the lack of conformity within two months of becoming aware of it. Failure to comply with this deadline will not entail the loss of the right to the corresponding remedy, the customer being responsible, however, for the damages or losses actually caused by the delay in communication. In any case, the guarantee related to those damages caused by an inadequate use is excluded, as well as in general all those excluded by the legislation of the European Union in force.
Jurisdiction and applicable law
For any dispute arising from this online sales contract shall be competent Spanish courts. Likewise, Spanish law (Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios) shall be applicable in all matters not provided for in this contract.
The European Commission offers a platform for alternative dispute resolution, which can be accessed at:http://ec.europa.eu/consumers/odr/ OfelitaT is not a member of any association or organization that offers an out-of-court dispute resolution system.
Intellectual and industrial property
All contents (including graphic design, source code, logos, text, graphics, illustrations, photographs, trade names, trademarks or distinctive signs and any elements that appear on the WEBSITE), unless expressly stated otherwise, are the exclusive property of OfelitaT or third parties.
No intellectual or industrial property rights over the WEBSITE or any of its integral elements are transferred to the client, and the reproduction, transformation, distribution, public communication, making available, extraction, reuse, resending or use of any nature, by any means or procedure, of any of them is expressly forbidden to the client, except in cases where it is legally permitted or authorized by the owner of the corresponding rights.
The customer may view and obtain a temporary private copy of the contents for his exclusive personal, private and non-collective use on his computer systems (software and hardware), provided that it is not for the purpose of developing collective activities or of a commercial or professional nature. The customer must refrain from obtaining, or attempting to obtain, the contents by means or procedures other than those that in each case have been made available or indicated for that purpose or those commonly used on the Internet (provided that the latter do not involve a risk of damage or disablement of the WEBSITE). The customer must at all times respect all intellectual and industrial property rights on the WEBSITE, owned by OfelitaT or third parties.
In any case, OfelitaT reserves the right to modify, at any time and without prior notice, the presentation and configuration of the WEBSITE, as well as these Particular Conditions.
